Laghu Udyog Bharati Delhi Prant Monthly Meeting: Key Issues and Observations

The monthly meeting focused on critical GST-related challenges faced by businesses. Members highlighted the importance of proper documentation, including invoices and photographs, for compliance and discussed instances where inadequate records led to disputes. Concerns were raised about the discretionary practices of GST officers, such as issuing arbitrary show-cause notices, corruption, and undue pressure on businesses. Emphasis was placed on maintaining detailed transaction records, including quality checks and signatures, to counter unjustified claims. Discussions also reviewed High Court and Supreme Court rulings on GST disputes, with particular attention to filing mismatches (e.g., GSTR 2A/3B) and their adverse impact on businesses.

Suggestions for reform included scaling GST appeal fees based on liability, addressing arbitrary penalties, and simplifying the reverse charge mechanism (RCM) to ease compliance for small businesses. The cancellation of GST registrations due to minor supplier non-compliance was identified as a significant concern, with calls for fair treatment and transparent processes. Participants also examined cases where court interventions helped businesses contest unjust GST demands and clarified ITC eligibility based on supplier compliance.

Policy recommendations focused on curbing corruption by limiting the discretionary powers of GST officers and introducing clearer guidelines to ensure fair treatment. Sector-specific challenges, such as those in gaming, packaging, and manufacturing, were addressed, alongside the need for sustainable practices like non-plastic packaging to meet environmental compliance. Members highlighted the role of Laghu Udyog Bharati in representing business concerns to the government and advocated for a unified approach to address systemic GST challenges.

The meeting concluded with calls for simplifying GST processes, enhancing transparency, and reducing litigation. Participants emphasized the need for greater education and awareness about GST compliance, particularly for small and unorganized businesses, and advocated for policy changes to alleviate financial and operational burdens while streamlining tax administration.
